By signing this Agreement, the Vendor agrees to abide by all terms and conditions below to ensure a respectful, family-friendly, and faith-based atmosphere, in accordance with California law.
1. Event Purpose
This event is organized by a Christian-based business and is focused on community, faith, family, and positive fellowship. Vendors are expected to uphold these values through their products, services, and behavior.
2. Vendor Conduct
To maintain a safe and respectful environment consistent with California law and event policy, vendors must adhere to the following:
No foul, vulgar, or offensive language at any time.
No smoking, vaping, or substance use (including cannabis) is permitted on event grounds, per California Health & Safety Code §11362.3.
No alcohol, drugs, or inappropriate material may be sold, displayed, or consumed.
No aggressive solicitation, discrimination, or harassment of attendees, staff, or other vendors, in accordance with California Civil Rights laws (Gov. Code §12940).
Vendors must maintain respectful, professional conduct at all times.
3. Music and Sound
Vendors are not permitted to play their own music, videos, or amplified sound.
The Organizer will provide approved music and announcements to maintain a consistent, family-friendly atmosphere in compliance with local sound ordinances.
4. Product and Service Approval
All products and services must comply with California law and reflect the event’s values. The following are strictly prohibited:
Profane, occult, sexual, or violent materials.
Counterfeit or unlicensed goods (per California Penal Code §350).
Products that directly compete with event sponsors or restricted vendor types, as communicated by the Organizer in advance.
Vendors must have all applicable business licenses and seller’s permits as required by the California Department of Tax and Fee Administration (CDTFA).
5. Setup, Operation, and Clean-Up
Vendors must be fully set up by 2:15 PM and remain open until 7:30 PM, unless otherwise approved by the Organizer.
Vendors must keep their booth area clean, professional, and hazard-free in compliance with Cal/OSHA safety standards.
Vendors are responsible for their own tables, tents, power, and supplies.
Clean-Up: Vendors are expected to leave their space in the same condition as before setup. Proper cleanup and care for the space are greatly appreciated and help the Organizer continue hosting community events.
6. Fees and Refund Policy
All vendor fees are non-refundable, except where otherwise required by California Civil Code §1723, which allows “no refund” policies as long as they are clearly disclosed prior to purchase (which this document satisfies).
Non-refundable fees apply regardless of cancellation, weather, or removal for non-compliance.
Vendor participation is confirmed only after full payment is received.
7. Liability and Indemnification
The Organizer shall not be held responsible for loss, theft, damage, or injury before, during, or after the event.
Vendors assume full responsibility for their property, staff, and operations.
Vendors agree to indemnify and hold harmless the Organizer, property owner, and affiliates from any claims, damages, or liabilities arising from their participation, except in cases of Organizer negligence or willful misconduct, per California Civil Code §2782.
8. Compliance and Removal
Failure to comply with any portion of this Agreement may result in immediate removal from the event without refund.The Organizer reserves the right to refuse participation to any vendor whose conduct or products are deemed inconsistent with the event’s values or California law.
9. Entire Agreement
This Agreement constitutes the entire understanding between both parties and supersedes all prior discussions or communications. No oral agreements shall be binding unless made in writing and signed by both parties.
10. Agreement and Signature
By signing below, the Vendor acknowledges and agrees to all terms stated above and understands that this is a Christian-based, family-oriented event created to uplift and serve the community in accordance with California law.
